Terms and Conditions for Storage Lease Agreement

1. Introduction

These Terms and Conditions govern the Storage Lease agreement through our website www.cleaningterminatorspecialists.com (the Cleaning Terminator Specialists). By signing a booking, you agree to be bound by these Terms and Conditions.

2. Booking Confirmation

Upon successful booking, you will receive a confirmation email detailing your appointment. Please review this information carefully and contact us immediately if there are any discrepancies.

3. Term

The term of this Lease shall commence on the time of booking, and shall continue on a month-to-month basis until terminated by either party in accordance with this Agreement.

4. Rent:
The Tenant agrees to pay Cleaning Terminator Specialists a monthly rent of $295 on the due date of the charge each month.

5. Payment Terms

All payments must be made in full in advanced before appointment being completed unless agreed by Cleaning Terminator Specialists. Accepted payment methods include Stripe, PayPal, credit card active direct debt.

6. Digital Key/FOB swipe access 

We charge a $55 fee  per FOB swipe. This is for accessing the building to the storage space. We may need to ask for a photocopy of your drivers license or passport for collection of the FOB.

7. FOB being ordered

On a event the FOB is not available for collection on the first month of order. Tenant will be credited per day until swipe card has been provided for a total of $295 of the month. This will be divided by per day of $295 on the month until swipe card has been organised to the tenant. I.e. total month rent / days without access = Credit amount.  For 5 days without a swipe card on the first month, $295 / 5 = $59 credit. Tenant has a option to cancel the agreement during this period and full refund will be issued. After the first billing cycle if a FOB key has not been organised, a full refund will be issued to the tenant at the next billing cycle and the agreement terminated.

​8. Insurance

We have insurance, booking through our website, we may offer insurance coverage as part of your appointment. However, please note that this insurance is not guaranteed and is subject to the PDS or Terms and Conditions set forth by the insurance provider.

9. Penalty Interest Rates

In accordance with the Penalty Interest Rates Act 1983 (Victoria), any overdue payments will incur interest at the rate specified under the Act. The current penalty interest rate is 10% per annum, calculated daily until the outstanding amount is paid in full.

10. Liability

If no insurance coverage offered by the insurance provider, we will not be liable for any indirect, incidental, or consequential damages arising from your use of the website or services booked through it. 

You will indemnify us and will be liable for, all loss and damage, out-of-pocket expenses and all other reasonable expenses and disbursements incurred by us in this matter, including but not limited to legal costs on a solicitor/own basis, Search fees and debt collection costs (as if the debt had been collected) and any other contingent expenses incurred by us for the enforcement of any obligations we are at liberty to take against you, for the recovery of moneys owed by you to us.

Cleaning Terminator Specialists shall not be liable for your luggage/personal goods on any loss, theft, or damage.

You will indemnify us against any claims arising from your luggage/personal goods.

You are encouraged to obtain insurance for luggage/personal goods, as our liability insurance is limited.

11. Prohibited Goods: The following items not to be stored through our services under any circumstances: Toxic, polluted or contaminated goods; firearms, munitions, weapons or explosives; radioactive materials; highly flammable or hazardous goods; living plants or animals; food or perishable goods (unless frozen food to be stored in a deep freezer); anything damp, mouldy, rotten or infested with or damaged by parasites; any item which emits any fumes or strong odour; illegal goods; waste; or any item whose presence would invalidate any insurance policy which would otherwise cover the items or the storage space

12. Body Corporate Rules

When signing this agreement, you also agree to the body corporate rules below and will be liability for any breaching occurred by you.

13. Default:  You will agree after 3 day overdue payment make a additional late fee payment is $20​​​.

3 days overdue a contractual lien over all your property stored. After 7 days overdue the contract immediate removal of all items from the Space. After 28 days overdue items in the Space to be abandoned by you and treated as such.

14. Termination:
Either party may terminate this Agreement by providing notice however at the end of the billing cycle the agreement will end.

15. Governing Law

These Terms and Conditions are governed by the laws of the State of Victoria, Australia. Any disputes arising from these Terms and Conditions will be subject to the exclusive jurisdiction of the courts of Victoria.

16. Amendments

We reserve the right to amend these Terms and Conditions at any time. Any changes will be posted on the Website, and your continued use of the Website following such changes constitutes your acceptance of the new Terms and Conditions.
